Who can claim after a rideshare accident
You can make a TAC claim if you were injured in a rideshare accident in Victoria as a:
- Passenger, including where your own driver caused the crash
- Rideshare driver
- Driver or passenger in another vehicle
- Pedestrian or cyclist struck by a rideshare vehicle
- Person injured getting in or out of the vehicle
It does not matter which platform was involved.
Rideshare accident compensation
- Medical treatment, hospital and specialist costs
- Rehabilitation and physiotherapy
- Income support while you cannot work
- A lump sum for permanent impairment, from 11% whole person impairment
- Pain and suffering and loss of earnings, where another driver caused a serious injury
The lump sum is worked out from a percentage, not negotiated. Independent doctors assess your permanent loss of function once your injuries have stabilised, and nothing is payable below 11%. Above that the amount is fixed by law and rises with the percentage. Find out what each band is worth.
What to save from the app
Rideshare claims have evidence available that most road accidents do not, and it lives on a phone you might replace.
Screenshot the trip, including the driver's name, the vehicle, the time and the route.
Keep the receipt. It is emailed automatically and establishes that you were in that vehicle at that time.
Report the accident in the app and keep a copy of what you sent, which creates a dated record.
Trip data can usually be requested from the platform afterwards, but keeping your own copy is quicker and more certain.
Claiming as a rideshare passenger
Yes. Being in the vehicle at fault does not affect your entitlement to treatment, rehabilitation or income support, and where a driver caused a serious injury a common law claim may also be available.
You do not need to have complained through the app, and you do not need the driver's cooperation.
Rideshare drivers injured while working
If you were injured driving for a rideshare platform, you have a TAC claim for the road accident. You may also have a WorkCover claim on top of it, but that depends on whether you are considered a "worker" under the legislation, and that turns on the facts of your relationship with the platform.
Being engaged as an independent contractor does not automatically rule you out. Contractors are not necessarily excluded and can be deemed workers where certain criteria are met, so it is worth having your arrangement looked at properly rather than assuming the answer.
The platform's insurance, and the TAC
A TAC claim is not replaced by anything the platform offers. Rideshare platforms carry their own cover, and drivers may hold rideshare specific policies on top of ordinary comprehensive insurance.
All of it sits alongside a TAC claim rather than replacing it. Accepting an offer from a platform or insurer does not remove your TAC entitlements, but it can complicate them, so it is worth understanding what is available under each before you settle anything.
The TAC side runs through its normal stages, alongside whatever is happening with the platform's insurer.

What to bring to your first consultation
- Your trip receipt or a screenshot of the trip
- Any report you made in the app, and the platform's reply
- The police report number, if there was one
- Medical reports and the names of your treating doctors
- Payslips or evidence of lost income
- Any correspondence from the platform or an insurer
