Who the TAC covers
You can make a TAC claim if you were injured on a Victorian road as a:
- Driver or passenger in a car
- Motorcycle rider or pillion passenger
- Cyclist, where a motor vehicle was involved
- Pedestrian, including where the vehicle was never identified
- Passenger on a bus, tram or train
- Rideshare passenger or driver

You do not need to hold a licence, own the vehicle, or live in Victoria. What matters is that the accident happened here and a vehicle was involved.
The TAC uses the term "transport accident", but most people will be searching for a traffic accident lawyer or road accident lawyer, and the two mean the same thing here. Any accident on a Victorian road involving a vehicle is covered, whether that vehicle is a car, a motorbike, a truck, a bus or a tram, and whether you were in it, on it, or walking past it.

The lump sum is worth explaining, because it is the part people understand least. Once your injuries have stabilised, independent doctors assess how much permanent function you have lost and express it as a percentage, called whole person impairment. Below 11%, no lump sum is payable at all. At 11% and above the amount is fixed by law and rises with the percentage, running from under $10,000 at the threshold to $451,650 for total impairment.

Fault, and where it actually matters
Your treatment, rehabilitation and income support do not depend on fault at all. They come to you because you were injured on a Victorian road, and nobody has to be found responsible for you to receive them.
Fault matters for one thing: a common law claim, the additional claim for pain and suffering and loss of earnings. That requires another person to have contributed, and your injury to be serious. If you were partly responsible, compensation is reduced to reflect your share rather than refused.
Time limits
Twelve months from the date of the accident. In some circumstances a claim can be accepted later however it is at the TAC’s discretion, and the limits work differently for children.
You do not need to know how serious your injury will turn out to be before you lodge. Waiting to find out is how the twelve months may get missed.

Types of road accidents
Every road accident claim runs through the TAC, but each type comes with its own questions and required documentation.
Road trauma in Victoria
In the twelve months to December 2025, 291 people lost their lives on Victorian roads: 123 drivers, 61 motorcyclists, 52 pedestrians, 45 passengers and 9 cyclists.
Serious injuries are a far larger group. In the 2023-24 financial year, 5,617 people were seriously injured on Victorian roads. Almost two thirds of those injuries happened in metropolitan Melbourne.
