ABOUT US

No Win No Fee Lawyers Melbourne

The Injury Law Group is a no win no fee personal injury law firm in Melbourne. If we take on your claim, you won't pay any legal fees unless we successfully win your case. That applies across TAC road accident claims, WorkCover, TPD, medical negligence and public liability.

Your first consultation is free, and before any work begins we set out our costs in writing and make sure you understand exactly what you will be paying for if you win.

Below, we explain how no win no fee works at our firm, what it costs, and what we will always tell you upfront.

We know that after an injury, money is often the first worry. We're here to take that worry off the table so you can focus on your recovery.

How does no win no fee work?

No win no fee means you don't pay our legal fees unless your claim succeeds. There are no upfront costs, and if your claim doesn't succeed, you don't pay us for the work we've done. Here's what that looks like in practice.

01. Free Consultation

We start with a free, no-obligation conversation. We'll listen to what happened, answer your questions and tell you honestly whether we think you have a claim worth pursuing.

02. A costs agreement

Before we do any work on your claim, we set out our costs in a written costs agreement. That's the document that explains what we charge, when we charge it and what happens if your claim doesn't succeed. We go through it with you in ordinary words and answer any questions before it's signed.

03. We run your claim

Our lawyers manage your claim from beginning to end. We prepare the paperwork, deal with the TAC, WorkSafe agents, insurers or the other side, gather the medical evidence and keep you informed at every stage.

04. You pay legal fees only if your claim succeeds

When your claim resolves and compensation is paid, our legal fees are deducted from that amount. You receive an itemised settlement statement showing exactly what you will receive in hand after costs.

What it costs, and what we will always tell you upfront

Two types of costs can arise in an injury claim, and it's worth knowing the difference before you speak to any lawyer.

Legal fees are what we charge for our time and work on your claim. Under no win no fee, these are only payable if your claim is successful.

Disbursements are the out-of-pocket expenses involved in running a claim. Medical reports, court filing fees, expert opinions and independent medical examinations are the common ones. These are costs paid to third parties, not to us. Your costs agreement will set out clearly how disbursements are handled as your claim runs and what happens to them if your claim doesn't succeed. We will explain this at your first consultation, before you commit to anything.

When your claim resolves, deductions for legal fees and disbursements come out of your compensation, not out of your pocket. You will never receive a surprise bill. Every settlement statement we prepare itemises what was received, what was deducted and why, so you can see exactly where every dollar has gone.

If you've been searching for no win no pay lawyers and found firms that are vague about costs, we understand the hesitation. Our approach is simple: we tell you what things cost before they cost you anything.

How we decide if we can act no win no fee

Under no win no fee, we carry the financial risk of your claim. So before we agree to it, we assess whether your claim has reasonable prospects of success.

That assessment happens at your free consultation. We look at how the injury occurred, who may be responsible, the evidence available and which compensation scheme applies. In most cases, we can tell you in one conversation whether we can act for you on a no win no fee basis. Because we carry the risk, we only take on claims we believe in.

If we don't think we can help, we'll tell you that too, and where possible we'll point you towards someone who can. Being told the truth early is better than being strung along.

If you've been injured at work or your work has made an existing condition worse, you may be entitled to WorkCover benefits and, in some cases, further compensation. Learn more about work injury claims.

TPD claims
If an injury or illness means you can no longer work, you may have a total and permanent disability claim through your superannuation fund. These claims are run no win no fee, and many people don't realise they have this cover. Learn more about TPD claims.

Medical negligence claims
If a doctor, hospital or other health professional has failed in their duty of care and you've been harmed as a result, we can advise on your options. FAQs

  • Is there a time limit for making an injury claim in Victoria?

Yes, and the limits differ by claim type. A TAC claim must be lodged within 12 months of the accident. Exceptions exist, but they are at the TAC's discretion. A WorkCover claim should be lodged as soon as possible, ideally within 30 days of the injury. If you have a common law claim under the TAC or WorkCover schemes, you have six years from the date of injury to issue proceedings. Public liability and medical negligence claims must be brought within three years of the date of injury. Missing a deadline can end a claim, so get advice early, even if you're not sure you want to proceed. Book a free consultation and we'll tell you exactly where you stand.

  • How much do no win no fee lawyers take in Victoria?

There's no single percentage, and be wary of any firm that quotes one before understanding your claim. At The Injury Law Group, your costs are set out in a written costs agreement before any work begins, and when your claim resolves you receive an itemised settlement statement showing every deduction. We'll explain both documents at your free consultation.

  • Will I have to go to court?

Most compensation claims resolve without a court hearing, through negotiation or settlement conferences. If your claim does need to go to court, we prepare you properly, run the case, and you make the final decision on any settlement offer. Either way, nothing about your no win no fee arrangement changes.

  • Can I move my claim to The Injury Law Group from another law firm?

Yes. You're entitled to change lawyers at any point in a claim. Your previous firm will still be entitled to the costs of the work it has done, so before your file transfers we either agree to those costs with them or give an undertaking to pay their share when your claim concludes. We have the file independently costed so the split is fair. If the cost of moving would leave you worse off, we'll tell you to stay where you are. If it makes sense to move, we'll handle the transfer for you.

  • What should I bring to my first consultation?

Whatever you have, and don't worry if it's not much. Useful things include the accident or incident details, any medical reports or the names of your treating doctors, correspondence from the TAC, WorkSafe agents or insurers, and payslips if you've lost income. If you have nothing on paper yet, come anyway. The consultation is free and we'll tell you what to gather.
