What do I do if I have been injured at work?
IIf you have been injured at work, you will need to give your employer a Worker’s Claim Form. To do this, you will need to visit your treating doctor (GP) to get a Certificate of Capacity and then send both the form and Certificate of Capacity to your employer who will then forward the claim onto their WorkCover insurer. The Injury Law Group can also help you with this.
Time limits apply so it is important you report your injury within 30 days of it occurring and seek legal advice as soon as possible so that you are aware of your entitlements. If you have a common law claim, this must be made within 6 years from the date of injury.
What types of compensation are available?
Under the Worker’s Compensation scheme, you may be entitled to:
1. Medical and like expenses – for treatment, rehabilitation and support services
2. Weekly payments of compensation - to cover lost wages if you are unable to work due to work-related injury or illness
3. Provisional Payments for mental injuries – available to workers who have suffered a mental injury immediately for the first 13 weeks while their claim is being assessed.
4. Lump sum compensation – if you have suffered a permanent impairment.
5. Work related Death benefits – available to family members when someone dies from a workplace accident/injury. Family members are entitled to lump payments for dependent partners and children, weekly pensions for dependent partners and children, funeral and counselling expenses.
6. Common law damages – in cases where negligence caused your injury and you can establish that your injury is serious, you may be able to claim additional compensation for pain and suffering and/or economic loss.
